Federal Court Delivers Blow: Trump's Gateway Funding Challenge Rejected

This vital infrastructure initiative aims to construct a new rail tunnel beneath the Hudson River, connecting New York and New Jersey, and is critical for improving rail travel along the Northeast Corridor, which currently relies on the century-old North River Tunnel, significantly damaged by Superstorm Sandy.
President Donald Trump had, in October, publicly declared the project "terminated" from the Oval Office, citing an impasse with Senate Minority Leader Chuck Schumer (D-N.Y.) regarding a funding bill. However, the president’s top budget officer, Russell Vought, presented an alternative reason at the time, stating that the funding was suspended while the administration reviewed whether the project violated an executive order banning the use of diversity initiatives for hiring contractors on federal projects.
In response to the funding freeze, New York and New Jersey initiated a lawsuit against the administration in February to unblock the funds. Judge Vargas promptly issued a temporary restraining order to ensure the funding continued to flow. While the lawsuit progressed, the Gateway Development Commission, the bi-state panel responsible for overseeing the project, was compelled to halt work on the tunnel for nearly two weeks. Monday’s court ruling by Judge Vargas permanently extends her earlier temporary decision, effectively preventing the administration from any future attempts to withhold money for the new tunnel.
Judge Vargas’s written ruling emphasized that the Trump administration "skipped right to payment suspension without any finding that [the Gateway Development Commission] had violated the law." Following the ruling, New York Governor Kathy Hochul and Attorney General Letitia James released a joint statement celebrating the victory, asserting, "This victory sends a clear message: the Trump administration's attempt to halt Gateway funding will not stand." The White House directed inquiries about the case to the Department of Transportation, which stated, "USDOT remains committed to ensuring hardworking taxpayer dollars are being spent responsibly and do not fund unconstitutional, discriminatory contracting practices." The Gateway Development Commission has consistently maintained its compliance with all of the Trump administration’s regulations concerning contractors.
