This contentious legislation seeks to significantly alter the nation's political landscape by extending the terms of Members of Parliament, mayors, and councilors from five to seven years. Furthermore, it proposes a radical shift in presidential elections, introducing an electoral college system that would effectively remove citizens' direct right to vote for the Head of State, thereby transferring this power to Parliament. The introduction of these changes follows President Mnangagwa's ascent to power in 2017, after the military-backed removal of long-time ruler Robert Mugabe.

The Bill's first reading by Justice Minister Ziyambi Ziyambi was met with a flurry of legal action, as approximately 67 applications were served on MPs leaving Parliament. Represented by Coghlan, Welsh & Guest Legal Practitioners, Casper seeks a declaration that even if the amendment is passed, its provisions should not apply to current office-bearers. He argues forcefully that incumbents cannot legally extend their own terms through constitutional amendments without triggering essential constitutional safeguards, including the requirement for a national referendum. The applicants collectively assert that key provisions of the Bill are inconsistent with existing constitutional protections related to term limits, specifically citing sections governing parliamentary tenure, presidential terms, and section 328(7), which they argue explicitly prevents amendments from extending the terms of current office-holders.

Beyond term limits, the Bill's proposal for an electoral college system in presidential elections is also under severe scrutiny. Applicants argue that this change would fundamentally infringe upon the political rights guaranteed under section 67 of the Constitution by transferring the crucial power of presidential selection from the direct mandate of voters to the hands of Parliament. This shift is seen as a significant erosion of democratic principles and citizen participation.

Given the urgency and purely constitutional nature of these questions, the applicants are seeking direct access to the Constitutional Court, bypassing lower courts for an immediate determination. Legal analysts observe that this strategy of deploying multiple parallel cases across different constituencies is designed to exert significant procedural pressure on Parliament as it attempts to advance debate on the Bill.

Meanwhile, the ruling Zanu-PF party, which commands a parliamentary majority, has responded by summoning its Members of Parliament for a caucus meeting. This gathering, announced by chief whip Pupurai Togarepi, underscores the high stakes involved as the Bill progresses through its legislative stages. The Constitutional Amendment Bill has rapidly become one of the most intensely contested legislative proposals in recent memory, attracting strong opposition not only from political figures and civil society organizations but also from retired government officials and an increasing number of individual voters who are now turning to the judiciary to safeguard constitutional integrity.
