PAC Recommendations Stalled: James Klutse Avedzi Blasts Impunity and Inaction

James Klutse Avedzi, the former Chairman of Parliament’s Public Accounts Committee (PAC), has raised significant concerns regarding the persistent failure to prosecute offenders involved in financial irregularities within Ghana’s public financial management system. He argues that this lack of enforcement directly contributes to the ongoing prevalence of misconduct and a severe weakening of accountability. Avedzi made these remarks during an interview on Joy FM's Super Morning Show on Thursday, April 2, amid ongoing PAC proceedings, emphasizing that the non-prosecution of individuals identified in audit infractions is the root cause of the problem.
A primary issue highlighted by Mr. Avedzi is the non-establishment of a constitutionally mandated Special Committee. He explained that although Article 187(6) of the Constitution provides for a mechanism to facilitate collaboration between the PAC and the Attorney-General to ensure audit infractions are acted upon, the committee responsible for enforcing the implementation of PAC recommendations has never been constituted. “The constitution also make a provision that, after all these, parliament must set up a Special Committee in the interest of the public, that committee will ensure that the recommendations of the Public Accounts Committee which have been adopted by the entire House are implemented. That is what we are lacking, that committee has never been set up. Since the inception of constitutional rule, we have never establish that committee, that is where the problem is,” he disclosed.
According to Avedzi, this critical gap in institutional coordination means that recommendations arising from PAC sittings, particularly those based on findings from the Auditor-General of Ghana, frequently fail to progress to prosecution or enforcement. He elaborated that if such a committee were in place, it would actively ensure that the Attorney-General acts on the adopted recommendations, thereby strengthening accountability. In the absence of this vital oversight, many cases presented before the PAC and subsequently referred to the Attorney-General appear to stall without further action, effectively undermining the integrity of the public financial management system.
Mr. Avedzi firmly believes that the absence of prosecution weakens accountability and emboldens misconduct. He argued that if even one person were prosecuted, jailed, or fined, it would serve as a powerful deterrent for others entrusted with public funds. However, the current cycle has become entrenched, with the PAC holding annual hearings on audit infractions but seeing limited or no follow-up action. Offenders have come to realize that “nothing happens” after appearing before the committee, leading them to commit crimes and feign ignorance during hearings, confident that no repercussions will follow.
Beyond the constitutional void, Mr. Avedzi also alleged significant procedural delays during his tenure as PAC Chairman. He recounted instances where the Clerk of Parliament initially refused to transmit the Committee’s recommendations for prosecution to the Attorney-General. It took persistent complaints, including reporting the Clerk to the Speaker and making a statement on the floor of Parliament, before the recommendations were eventually forwarded. This obstruction, he noted, severely hampered the pace at which cases could be handled.
Over a two-year period, numerous recommendations for the prosecution of individuals cited in audit infractions did not yield results due to these delays in forwarding the cases. Avedzi suggested that this lack of consistent follow-through contributed significantly to weak enforcement of accountability measures, allowing cited irregularities to persist. He stressed that consistent prosecution is essential to enforce discipline, promote transparency in public financial management, and restore confidence in the system, which currently suffers from eroded trust due to unaddressed misconduct.
