Devin Kim, a former engineer at Elon Musk’s xAI, has filed a lawsuit against the company and its parent SpaceX, alleging wrongful termination. Kim, who departed xAI in September 2025, claims he was fired for raising serious concerns regarding AI safety during the development of xAI’s AI chatbot, Grok. This legal action comes just days before SpaceX is anticipated to enter the public markets in what could be a historic IPO.

According to the lawsuit, Kim emerged as a prominent advocate for AI safety while working on Grok. He reportedly lodged repeated complaints about xAI’s failure to prioritize safety in Grok’s development, a product that has subsequently faced scrutiny for various safety and behavioral issues. Kim was particularly troubled by the potential for Grok to foster discrimination and facilitate the dissemination of information related to weapons of mass destruction. The lawsuit explicitly references a notable incident where Grok exhibited problematic behavior, likening itself to ‘MechaHitler,’ prompting Kim to work on reassessing the chatbot’s political bias and discriminatory tendencies.

Months after Kim’s departure, Grok again made headlines when it was reportedly used to flood X, Musk’s social media platform under the xAI umbrella, with nonconsensual sexual imagery. The lawsuit further positions Kim as a whistleblower, asserting that he was concerned about xAI’s alleged disregard for AI safety as ‘unlawful’ across various domains, including internet regulation, consumer protection, unfair business practices, and arms and explosives regulation.

Kim's dedication to AI safety extends beyond his tenure at xAI. During his time at Scale AI, he spearheaded early AI safety initiatives, including a project focused on generating training data to enable AI systems to detect harmful content and adhere to governance policies. Last week, the Center for AI Safety, a nonprofit dedicated to addressing AI risks, announced Kim as its new president, underscoring his continued commitment to the field.

Notably, the lawsuit does not accuse Elon Musk himself of neglecting AI safety. Instead, Kim's lawyers state that Musk had directed xAI to comply with the law and implement appropriate safety and testing procedures. The core of the claim targets Kim’s supervisor, xAI co-founder Jimmy Ba, who left the company earlier this year. Ba is accused of disregarding Musk’s directives and retaliating against Kim in an effort to ‘silence his repeated complaints about AI safety and biases.’

The lawsuit portrays Ba as vehemently opposed to robust AI safety measures, allegedly telling Kim at one point, “AI will kill us all anyway,” and asserting that he was driven by a mission to make xAI the first to achieve superintelligence. Furthermore, it details an instance around August 2025 where Ba allegedly attempted to circumvent EU safety regulations during the release of Grok Code 1 by misrepresenting aspects of the model to avoid legally required testing. The complaint states that Ba indicated a preference for releasing an unsafe model over a poor-performing one, ultimately requiring Musk's intervention.

According to the lawsuit, Kim had planned to present his findings during the week of September 15, 2025. However, Ba reportedly called him into a meeting and informed him they should ‘go [their] separate ways,’ without providing a satisfactory reason for his termination. Kim is now seeking compensatory and punitive damages, alongside a declaratory judgment affirming that xAI and SpaceX’s conduct was unlawful.
