Company opposes Arkansas Senate bill requiring consent before towing
SPRINGDALE, Ark. (KNWA/KFTA) — A Fayetteville tow truck company general manager pushes back against one Arkansas Senate bill.
Tim Moody of J Hook Towing & Recovery opposes Arkansas Senate Bill 541, filed by Democrat State Sen. Greg Leding of Fayetteville. The bill would require tow truck companies to get consent from a vehicle or property owner before it gets towed, eliminating non-consent tows.
“This is not a good bill,” Moody said. “It’s never going to work, and it’s going to hurt this industry very, very bad.”

A consent tow, Moody said, is if your car breaks down, you call a tow company and need to get towed somewhere, for example. Moody said examples of a non-consent tow are if a car is parked illegally and is taken off a lot without the owner knowing or a driver gets in a wreck and is taken to the hospital to get treated before a decision is made on what should be done with the car.
Another aspect of the bill is that if a car is towed without consent, the owner can get it back from the impound lot for free, Moody said. He added it’s going to put “a strain” on the tow industry.
“We’re told by property owners to come remove these vehicles, so we send a guy out at 2 or 3 a.m. to get it,” Moody said. “They’re going to bring it to the yard. He won’t get paid, and we won’t get paid.”
This will result in, Moody said, accidents not getting responded to and abandoned vehicles being left around.
KNWA/FOX24 reached out to Leding and co-sponsors State Sen. Alan Clark and State Rep. Richard Womack for comment on the bill but received no response.
