Ghana Erupts as Supreme Court Overturns Kpandai Election, Igniting Political Firestorm!

The Supreme Court of Ghana has reinstated Matthew Nyindam as the Member of Parliament for Kpandai, overturning a High Court decision that had previously annulled his election victory. In a 4–1 majority ruling, the apex court determined that the High Court had erred in law and acted without the requisite jurisdiction in its initial judgment, with Justice Gabriel Scott Pwamang dissenting from the majority.
Mr. Nyindam, representing the New Patriotic Party (NPP), had invoked the Supreme Court’s supervisory jurisdiction to challenge the High Court’s annulment. The core of the legal dispute revolved around the timing of the election petition filing in relation to the gazette notification of the 2024 parliamentary election results for the Kpandai constituency. Ghana’s electoral laws mandate that an election petition must be filed within 21 days of the Electoral Commission (EC) gazetting the results, with any petition filed outside this period deemed incompetent and beyond the court’s jurisdiction.
Matthew Nyindam’s legal team argued that the EC gazetted the results on December 24, 2024, rendering any petition filed after the subsequent 21-day window incompetent. Consequently, they contended that the Tamale High Court lacked the jurisdiction to entertain the petition. Conversely, the National Democratic Congress (NDC) maintained that the 2024 elections presented a unique situation where the EC issued two gazette notices: one on December 24, 2024, and another on January 6, 2025. The NDC asserted that the latter gazette superseded the earlier one, making January 6, 2025, the operative date for calculating the filing period, thereby arguing that their petition was filed within the lawful timeframe and the High Court acted appropriately. However, the majority of the Supreme Court justices did not favor the NDC’s argument.
Following the Supreme Court's decision, Matthew Nyindam expressed profound gratitude to God, the Supreme Court, and the people of Kpandai, describing the ruling as a victory for democracy and a validation of the electorate's will. He specifically thanked former Vice President Dr. Mahamudu Bawumia for his invaluable support and encouragement throughout the legal battle. Mr. Nyindam also extended appreciation to the NPP's national, regional, and constituency leadership for their steadfast backing.
