Restrain EC from rerun in any of Ablekuma North's polling station - Akua Afriyie prays court
Nana Akua Afriyie is the New Patriotic Party Parliamentary Candidate for Ablekuma North
The 2024 Ablekuma North Parliamentary Candidate of the New Patriotic Party (NPP), Nana Akua Owusu Afriyie, has petitioned the Accra High Court for an injunction to restrain the Electoral Commission from conducting a rerun of the parliamentary elections in any of the 281 polling stations within the Ablekuma North constituency.
In a lawsuit filed on her behalf by lawyer Gary Nimako Marfo, she is seeking among other things, an order of certiorari to quash the Electoral Commission’s decision, an order of prohibition to prevent the rerun, and a directive compelling the Commission to comply with the court’s January ruling.
The suit alleges that the EC acted "arbitrarily, capriciously, and in excess of its jurisdiction."
Akua Afriyie’s legal action follows the Electoral Commission’s announcement of a planned rerun of the parliamentary election in 19 polling stations within the constituency, scheduled for July 11, 2025.
She has since rejected the EC’s decision, arguing that results from all but three polling stations in the constituency had already been collated.
“I got the news from my national executives who represented us, but I am not happy with it. We are not going to accept this decision. My reason is very simple. We have gone through all the collation, and we are at three polling stations for us to complete the collation and declaration, and so, what's changed?” she stated in a July 3, 2025 interview.
Akua Afriyie further expressed displeasure, noting that the Electoral Commission had previously corroborated her claim that results from only three polling stations were yet to be collated when it appeared before Parliament to provide updates under oath.
She expressed concern that the Electoral Commission’s "U-turn" could set a dangerous precedent, and if left unaddressed, might undermine the country’s democratic processes.
“We had EC coming to Parliament, swearing under oath that we have only three polling stations left. Consistently, that is what it has been throughout and so, if NDC is bent on taking the seat and going to an extent of requesting for a rerun, and if EC that has always insisted also that we are left with only three polling stations, comes back to say that ‘we have agreed on NDC's decision, then where are we meeting as a country?” she said.
“What I am saying is we are not going to agree. We are not agreeing to this. This can never be a solution. If an NDC tells you that this is a solution for a future something, we are rather jeopardising the situation. The country where we are now is not a democracy,” she added.
