BREAKING: High Court dismisses Akua Afriyie's injunction application against EC in rerun

The Accra High Court has dismissed an injunction application that sought to stop the Electoral Commission from rerunning the parliamentary election in 19 polling stations within the constituency
The injunction application filed on July 6, 2025, by Nana Akua Owusu Afriyie was part of the New Patriotic Party’s (NPP) efforts to stop the upcoming rerun scheduled on Friday, July 11, 2025.
Justice Ali Baba Abature, presiding over the court on Wednesday, July 9, 2025, ruled that the ex parte application was “unmeritorious.”
Despite arguments from Owusu’s legal team, led by Director of Legal Affairs Garry Nimako Marfo, that the rerun would cause massive harm to their client, the court dismissed the application.
The party had earlier described the Electoral Commission’s decision and directive as ‘unjust,’ criticizing its handling of the matter.
Nana Akua Owusu Afriyie petitioned the Accra High Court for an injunction to restrain the Electoral Commission from conducting a rerun of the parliamentary elections in any of the 281 polling stations within the Ablekuma North constituency.
Accusing the Electoral Commission of acting 'arbitrarily, capriciously, and in excess of its jurisdiction,' she sought, among other remedies, an order of certiorari to quash the Commission’s decision, an order of prohibition to prevent the rerun, and a directive compelling the Commission to comply with the court’s January ruling.
Meanwhile, the party has rejected the EC’s rerun, indicating they will not partake in it.
