Ablekuma North Constituency election: High Court dismisses NPP's interim injunction - EC to go ahead with polls

The ex-parte application was filed by Nana Akua Owusu Afriyie, the New Patriotic Party’s (NPP) parliamentary candidate for the Ablekuma North Constituency in the 2024 election.

She was praying the court to halt the EC's election proceedings for 10 days to allow the EC to justify its failure to comply with an existing High Court order dated January 7, 2025, regarding the collation and declaration of results from 62 outstanding polling stations, in addition to the 219 already collated in the constituency.

In a ruling yesterday, the court, presided over by Justice Ali Baba Abature, dismissed the application as unmeritorious.

The judge stated that the balance of convenience favoured the respondents (EC), who have the constitutional mandate to conduct elections, ensuring that the people of Ablekuma North have proper representation in Parliament, which is their constitutional right.

“The respondent, as an extension of the executive arm of government, would be in a position to adequately compensate the applicant in damages should Afriyie win the substantive case,” the judge concluded.

On January 4 this year, the High Court in Accra, presided over by Justice Forson Baah Agyapong, ordered the EC to collate and declare the results of 62 outstanding polling stations in addition to the 219 already collated in the constituency.

The ruling followed a legal action by Afriyie, who filed an application in the nature of mandamus to compel the EC to complete the collation of the full results.

The court held that the EC had failed in its mandatory duty by declaring the National Democratic Congress (NDC) candidate, Ewurabena Aubynn, as the winner without collating results from all 281 polling stations.

In response to the judgment, the EC commenced collation on January 6 but could only complete the process for 59 out of the 62 outstanding polling stations, leaving three unresolved due to disagreements between the parties involved.

Subsequently, on July 2, the EC fixed July 11 as the date for a re-run of the parliamentary election in 19 polling stations in the Ablekuma North Constituency.

The NPP has stated that it will not take part in any rerun of elections in the 19 polling stations in the Ablekuma North constituency on Friday, July 11, 2025.

“We will not go for any rerun.

We have won the elections.

What we are asking the Electoral Commission is to follow the court directive, finish the collation and declare our candidate, Nana Akua Owusu Afriyie, as the MP-elect for Ablekuma North,” it noted.

At a press conference in Accra last Tuesday, the party’s General Secretary, Justin Kodua Frimpong, said the party had evidence that Nana Akua Afriyie won the seat.

Meanwhile, the EC has expressed its readiness to conduct the rerun in the 19 polling stations currently in dispute in the Ablekuma North Constituency to conclude the 2024 parliamentary contest in the constituency.

In a statement issued on July 2, 2025, the EC said the rerun election decision was made after extensive deliberations by the elections management body with the National Democratic Congress NDC and the NPP at a meeting in Accra on July 1, 2025.

The rerun election will be held on Friday, July 11, 2025, at the affected polling stations, with the EC calling on the state to provide the needed security to ensure a safe environment for the conduct of the election.

A statement named the affected polling stations as God First International School at Darkuman (1); Pentecost Church Mount Zion Assembly at Kwashieman; DVLA Office at Awoshie Adamami; Asiedu Gyedu Memorial School at Awoshie (1); Living Spring Day Nursery at Kwashiebu (1); The Lord’s Pentecostal Church at Kwashiebu; the Presbyterian Church at Odorkor (4); Church of Pentecost at North Odorkor (2); Church of Pentecost at North Odorkor (4); Methodist Church at Odorkor (1), and St John the Baptist Catholic Church at Odorkor (1).

The others are Radiant Way Preparatory School at North Odorkor (2); Ateco School Complex at Odorkor; South Odorkor 4 & 5 School (3); Church of Pentecost at Tweneboa (2); Light of Gospel Miracle Chapel at Tweneboa (2); MTTD Odorkor Divisional Station (1); Roman Catholic Church at Busia Junction at Odorkor (1) and Bethel Baptist Church at Sakaman (1).
Reason for rerun

The contending parties were in dispute over the results of 37 polling stations, each raising concerns about the acceptability of the results.

The EC explained that the rerun was necessary because results from the 19 polling stations, although approved by agents of both political parties, were not verified by the presiding officers responsible for those stations.
