Malema Under Fire: Security Tightens for Firearm Discharge Court Hearing

Economic Freedom Fighters (EFF) leader Julius Malema appeared before the East London Magistrate’s Court on Friday for pre-sentencing proceedings, following his conviction on charges related to the discharging of a firearm. The incident in question occurred during the EFF’s fifth anniversary celebrations at Sisa Dukashe Stadium in Mdantsane in 2018. The court appearance was met with significant public attention and a substantial gathering of EFF supporters in East London, who held vigils and protests in solidarity with their leader.
Malema was found guilty of several offenses, including unlawful possession of a firearm and ammunition, discharging a firearm in a built-up area, and reckless endangerment. The conviction stems from an incident where he fired a gun into the air during the party's anniversary event. Throughout the legal process, Malema has maintained his innocence, claiming the firearm involved was a toy, and has consistently indicated his intention to appeal both the conviction and any sentence that may be imposed by the court.
The EFF leadership has rallied firmly behind Malema, viewing the court case as a politically motivated attack aimed at silencing the party. EFF Secretary General Marshall Dlamini addressed supporters, reiterating the party's unwavering confidence in Malema’s leadership and pledging full support for his appeal. Dlamini emphasized that Malema would continue his work leading the struggle for the poor and landless, regardless of the outcome, stating, “This is a political attack on the EFF, and we remain confident that justice will ultimately prevail.”
Thousands of EFF supporters converged on East London ahead of the proceedings, having held an overnight vigil on Thursday night. Dressed in the party’s signature red regalia, they sang struggle songs and displayed placards outside designated gathering areas, echoing the sentiment that the case was politically driven. A heavy police presence and heightened security measures were deployed around the magistrate’s court to monitor the gatherings and ensure peace during the proceedings, which have drawn national attention from both supporters and critics.
During the pre-sentencing phase, the court is expected to hear arguments in mitigation and aggravation of sentence. These proceedings will ultimately determine whether Malema faces a direct custodial sentence or an alternative penalty. Lobby group AfriForum has previously underscored the seriousness of the charges, arguing that they could warrant imprisonment, adding another layer of complexity to the highly anticipated ruling which is expected at a later stage.
