High-Stakes Resignation: US Attorney Exits Amidst James Mortgage Probe

A federal prosecutor in Virginia, Erik Siebert, has resigned from his position as US attorney for the Eastern District of Virginia following pressure from Trump administration officials. Siebert was reportedly told he would be removed for not pursuing mortgage fraud charges against New York Attorney General Letitia James. The decision to step down came after public speculation regarding his tenure.
Siebert, who was nominated by President Donald Trump for the role in May, began his career as a prosecutor in Richmond in 2010. Administration officials had specifically requested Siebert to prosecute James over allegations of mortgage fraud related to a Virginia home she owned. However, Siebert’s office concluded that there was insufficient evidence to bring charges against James.
Letitia James, known for leading a successful civil fraud prosecution against Donald Trump and his company, has consistently denied any wrongdoing in the mortgage fraud allegations. Earlier on the day of Siebert's resignation, Trump publicly stated his desire for Siebert to be "out," remarking, "It looks to me like she’s very guilty of something, but I really don’t know" concerning James.
The Justice Department’s inquiry into James originated from claims made by Federal Housing Finance Agency Director Bill Pulte. Pulte alleged that James might have committed mortgage fraud based on the residence status she declared on her applications. James's victory in the $454 million civil fraud case against Trump in 2024, prior to his election, further intensified the political backdrop, although a New York appeals court later reduced the financial penalty while upholding the finding that Trump inflated his assets.
The targeting of James was part of a broader effort led by Justice Department official Ed Martin, which also included Federal Reserve Governor Lisa Cook and California Senator Adam Schiff, all facing similar mortgage fraud allegations. All three Democrats have denied committing fraud. Martin was appointed by Attorney General Pam Bondi to lead the department’s "weaponization group," established in response to Trump's executive order titled "Ending the Weaponization of the Federal Government."
Separately, the Justice Department has also launched an investigation into James concerning the civil fraud case she won against Trump. The administration's focus on other Democrats included Trump's attempt to fire Lisa Cook over mortgage fraud claims, which led to a lawsuit and a federal judge allowing Cook to remain in her position. Trump has appealed this to the US Supreme Court. Adam Schiff, a prominent antagonist of Trump, was preemptively pardoned by President Joe Biden along with others who served on the special House committee investigating the January 6, 2021, Capitol assault.
Erik Siebert's career saw him rise through the ranks of the US attorney’s office in Virginia’s Eastern District, where he was named interim US attorney in January before his formal nomination by Trump. Federal judges in the Eastern District of Virginia unanimously installed him as US attorney in May while awaiting Senate confirmation. There is a possibility he may continue as a federal prosecutor in the office after his removal from the top position.
