The VAR review acknowledged Dias's clear and deliberate push. However, under Law 12, "Direct and indirect free kicks and penalty kicks can only be awarded for offences committed when the ball is in play." Since the ball had not been played by Tonali at the exact moment Dias pushed Burn, the ball was not active, preventing VAR from intervening for a foul. VAR has no jurisdiction to get involved without the ball in play, unless an act of violent conduct occurs, which was not the case here.

Davies’s verdict highlighted that while Newcastle players and supporters would understandably feel hard done by, Dias's action was a "calculated action by Dias and the City backline, who clearly understood the law and timed the push to perfection." Within the Laws of the Game, no offense could legally have been committed here, and only the referee on the field could have intervened to manage physical contact prior to the ball being in play.

Another contentious moment arose in the 51st minute concerning Manchester City's Bernardo Silva. Already cautioned, Silva appeared to jump into Burn without attempting to play the ball, raising questions about a potential second yellow card. However, the VAR did not view this as a possible red card challenge and, crucially, under current rules, VAR is unable to intervene in possible second yellow card situations; their jurisdiction is limited to straight red card decisions.

The verdict on Silva's challenge suggested that for a referee (Tom Bramall in this case) to issue a second yellow, the challenge needs to be unequivocally clear and immediately recognizable as such. While watching the clip in isolation, Silva was fortunate not to receive a second yellow for an unnecessary challenge, Davies concluded that in the context of a physical game, it wasn't a "standout moment" that would have caused the referee "too much discomfort in real time," indicating sensible game management by Bramall.
