Tinubu's Son-In-Law, Oyetunde Ojo Accused Of Land Grabbing, Criminal Trespass In Abuja Estate | Sahara Reporters

The firm claims that unknown armed men, allegedly acting under Ojo’s instruction, forcibly invaded the property, threatening lives and obstructing access.

A concerned Nigerian company has petitioned the Chief Commissioner of the Public Complaints Commission, alleging gross abuse of office by Mr Oyetunde Oladimeji Ojo, the Managing Director of the Federal Housing Authority (FHA) and son-in-law of President Bola Tinubu.

In the complaint dated June 7, 2025, the legal representatives of SOMSMART V.C Int'l Nigeria Ltd accused Ojo of illegally carving out and reallocating Plot MF 14, 69 Road, Gwarinpa Estate, Abuja — land lawfully acquired and occupied by their client.

The firm claims that unknown armed men, allegedly acting under Ojo’s instruction, forcibly invaded the property, threatening lives and obstructing access.

The petition, obtained by SaharaReporters on Friday, detailed numerous allegations, including criminal trespass, intimidation, breach of public peace, malicious damage, and unlawful interference with proprietary rights, in violation of the 1999 Constitution and the Land Use Act.

According to the petition, the land was initially allocated to A-Z Global Shelter Solutions Ltd by FHA in 2017 and later lawfully acquired by SOMSMART, with formal consent registered by the authority in October 2023.

However, following Ojo's appointment as FHA boss, the firm says it began facing harassment by individuals claiming new allocations, allegedly given “by their friend, the Managing Director.”

The complaint further alleges that on June 30, 2025, heavily armed men invaded the property at gunpoint, marking and subdividing the land while threatening to kill anyone who resisted. These men reportedly claimed to be acting on behalf of Ojo.

The petitioner explained that this is not only a gross abuse of his revered office but malfeasance in public office, misconduct, and a breach of public trust.

The firm noted that no Nigerian citizen should be stripped of their property rights unlawfully and through intimidation.

The legal team cited violations of Sections 43 and 44 of the Nigerian Constitution, which guarantee citizens the right to own and be protected in their immovable property.

In their plea, the complainants called for the immediate intervention of the Public Complaints Commission to investigate the matter, protect their client’s life and property, and prevent further breakdown of law and order.

The statement read, "We have been consulted and our Services retained by SOMSMART V.C INT'L NIGERIA LTD (herein-after referred to as our client) in respect of the above captioned subject matter with instructions to deal.

"Please be informed that this Petition is predicated on the abuse of office, disrespect to extant laws of fhe Federal Republic of Nigeria, Harassment, llegal Carving Out of plot of land from our Clients existing land, Alienation and Allocation of land from ofher persons existing land without due regard to the Land Use Act, Criminal Trespass, Intimidation, Breach of Public Peace, Malicious Damage, Forceful/llegal entry, Unlawful Tampering of our Client's property known as and situate at Plot MF 14, 69 Road, Gwarinpa, Abuja by Unknown Armed Men allegedly acting under the instructions of Hon.

 Oyetunde Oladimeji, Managing Director, Federal Housing Authority in absolute disregard to the rule of law and in readiness to breach the peace with the capacity to lead to the breakdown of law and order.

"The Federal Housing Authority sometime is 2017, allocated Plot No. MF 14 along 69 Road, Gwarinpa Estate, Abuja to A-Z Global Shelter Solutions Limited and following the aforementioned allocation, our Client for a valuable consideration acquired the said property and the consent was duly registered by the Federal Housing Authority on the 11th day of COctober, 2023.

"We are informed that upon the purchase of the said property, our Client took physical possession of the subject property and having registered their interest, acquired both equitable and legal rights without any encumbrance thereof. However, upon the assumption of duty of Hon. Oyetunde Oladimeji Ojo, as the Managing Director, Federal Housing Authority, our Client's plot of land started experiencing traffic by so many Unknown Persons who alegedly claimed that they had been allocated the said plot of land by their friend, the Managing Director of the Federal Housing Authority, Hon. Oyetunde Oladimeji Ojo.

"Instructively, the Managing Director of the Federal Housing Authority, Hon. Oyetunde Oladimeji Ojo, in outright abuse of the public office which he OcCUDies set in motion, an administrative procedure to effectively deny our Client his possessory right over Plot No. MF 14 along 69 Road, Gwarinpa Estate, Abuia contrary to specific circumstances stipulated under the Land Use Act to the effect that alienation, carving out, marking out with intention of allocating someone else's land to another person must be predicated on public interest."

According to the petition, "Please be informed that our Client has been in actual possession and has Used the said property for their business activities until recently when the Managing Directing of the Federal Housing Authority, Hon. Oyetunde Oladimeji Ojo took steps in total disregard to the Constitution and extant laws of the Federal Republic of Nigeria.

"Obviously, the use of Unknown Persons to carve out, alienate, mark out other plots of land without notice and allocating same to his fanily and friends is not only a gross abuse of his revered office, but also malfeasance in public office, official r misconduct, abuse of public trust, disregard to the Grundnorm and the extant laws of the Federation of Nigeria.

"It is our understanding that the unlawful Carving Out, Marking Out, Alienation of our Client's property known as Plot No. MF 14 along 69 Road. Gwarinpa Estate, Abuja by the Managing Director of the Federal Housing Authority, Hon. Oyetunde Oladimeji Ojo is tantamount to improper use of his authority particularly his statutory authority as the Managing Director of Federal Housing Authority, an authority he has exercised unlawfully in gross contravention of the Land Use Act and other statutes of the Federal Republic of Nigeria."

The statement continues, "TAKE NOTICE that the action of the Managing Director of the Federal Housing Authority, Hon. Oyetunde Oladimeji Ojo further contravenes the fundamental rights of our Client as enshrined in Sections 43 and 44 of the Constitution of the Federal Republic of Nigeria, 1999 (as altered) which provides to wit:

 "Subject to the provisions of this constitution, every citizen of Nigeria shall have the right to acquire and own immovable property anywhere in Nigeria."

"Furthermore, it is our understanding that the actions of the Managing Director of the Federal Housing Authority, Hon. Oyetunde Oladimeji Ojo is further a misuse and improper exercise of his statutory authority which he sWore to uphold upon assumption of office, by his oath of office, Hon. Oyetunde Oladimeji Ojo he undertook to protect, respect and observe the extant laws at al times.

"It is further our position that Hon. Oyetunde Oladimeji Ojo breached Section 44 아f the Constitution of the Federal Republic of Nigeria, 1999as altered) which provides to that:

"No moveable property or any interest in an immovable property shall be taken possession of compulsorily and no right over or interest in any such property shall be acquired compulsorily in any part of Nigeria except in the manner and for the purposes prescribed by law.........*

"We are further informed by our Client that the Unknown Armed men were armed with all manner of dangerouS weapons ranging from guns, knives and other unspecified class of weapons capable of maiming and having debilitating effects on human beings, have taken over the land thereby preventing our client from entry into the land. This has caused serious apprehension to our Client considering the fact that it was administratively orchestrated to grab our Client's land, contrary to the extant laws of the Federal Republic of Nigeria."

They stated, "TAKE NOTICE, that on the 30th day of June 2025, to confirm his suspicions, our Client received a distress call that a group of Unknown Armed Men invaded the property at gun point and threatened kill anyone claiming title to the land except such person a vacates the property without the intention of ever returning there at.

"Instructively upon inquiry, the qun wielding persons who were spotted marking and carving our plots from an already existing. established and allocated plot of land belonging to our Client alleged that they were allocated to them by the Managing Director of the Federal Housing Authority. Hon. Oyetunde Oladimeji Ojo.

"It is instructive to note that the intention of the unknown armed men was to forcefully take over the subject property and occupy same illegally whilst alleging that they have been allocated the said plots of land by the Managing Director of Federal Housing Authority, this is a gross breach of the Land Use Act, the Constitution of the Federal Republic of Nigeria as altered and other established laws of the great country.

 OUR POSITION

"It is important to reiterate the Supreme Court decision in the case of FAWEHINMI V AKILU & ANOR, RE: ODUNEYE DPP (1987) 4 NWLR (PT.67) 797 8870 where it was held inter alia that the usual procedure when a crime is reported is to invoke their statutory powers and conduct detailed investigation.

"Culminating from the foregoing, it is Our firm and resolute position that this is a clear case of Criminal Trespass, Harassment, Intimidation, Breach of Public Peace, Malicious Damage and Ilegal/Fraudulent entry, llegal marking. carving, subdivision of property for delimiting and Tampering with our Client's Possessory Rights over the property known as Plot No. MF 14 along 69 Road, Gwarinpa Estate, in total disregard of the Crimindl Code Laws and The Constitution of Federal Republic of Nigeria 1999 (as altered).  

"Please take notice that our Client remains to be under intense apprehension for his life more notwithstanding that he has enjoyed undisturbed access to the land porior to the appointment of Hon. oyetunde Oladimeji 음g the Managing Director of Federal Housing Authority.

"The foregoing account of the actions of Unknown Persons acting on the instruction of Hon. Oyetunde Oladimeji Ojo, the Managing Director, Federal Housing Authority, suggests that the Constitution of the Federal Republic of Nigeria, 1999 as (altered), and the Land Use Act has been breached in total disregard of the oath of office which the Managing Director declared to uphold.

"On the backdrop of the foregoing. we urge you to use your good offices to invoke your statutory powers and bring the aforementioned Unknown Armed Men and other unknown persons to book so as to protect our Client's life and property, deter further perpetration of such criminal acts and protect our Society at large from these criminal minds.

"In all it is imperative, as a fundamental rule of law, that nobody is above the law and our law has zero tolerance for illegality. Thank you for your steadfast quest in seeing that justice is served as we anticipate your swift reaction and please accept assurances of our highest professional regards," they added.
