Scale AI Sues Rival Mercor for Alleged Trade Secret Theft
Scale AI Inc., a prominent data-labeling startup, has initiated a lawsuit against its rival, Mercor, alleging the theft of trade secrets to secure new business. The complaint, filed in San Francisco federal court, centers on accusations against Eugene Ling, Scale’s former head of engagement management, who is alleged to have downloaded over 100 confidential customer strategy and proprietary documents to his personal Google Drive. These actions purportedly occurred while Ling was actively communicating with Mercor.

According to the lawsuit, Ling reportedly met with Mercor CEO Brendan Foody during his tenure at Scale. Other Mercor employees allegedly engaged in discussions with Ling about Scale’s internal business strategies and products. A key allegation further states that Ling contacted a significant (but unnamed) Scale customer on behalf of Mercor while still employed at Scale.
Mercor is accused of continuing to utilize Ling on this specific customer’s account, with a substantial portion of the stolen documents relating to this particular client.
Mercor’s Response and Ongoing Investigation
Surya Midha, co-founder of Mercor, acknowledged the situation, stating the company is actively investigating the matter. Midha emphasized that while Mercor has hired several former Scale employees. However, Mercor disavows any interest in Scale’s trade secrets and cliaims to operate independently.
Midha also noted that Ling informed Mercor about old documents stored on his personal Google Drive, which Mercor claims it has never accessed. Reportedly, Mercor reached out to Scale six days before the lawsuit, offering to have Ling destroy the files or find an alternative resolution.
Industry Tensions and Competitive Landscape
This legal dispute underscores the intense competition within the artificial intelligence industry’s data-labeling sector. Scale AI, founded in 2016, has long been a leader in providing data annotation services essential for AI model development. However, the company has recently faced growing pressure from emerging competitors.
Scale AI’s Public Statement
Joe Osborne, a spokesperson for Scale AI, reiterated the company’s commitment to protecting its intellectual property, stating:
"Scale has become the industry leader on the strength of our ideas, innovation, and execution. We won’t allow anyone to take unlawful shortcuts at the expense of our business."

The lawsuit follows significant business shifts for Scale AI. In June, Meta Platforms Inc. finalized a $14.3 billion investment, acquiring a 49% stake in the company. Following this deal, Bloomberg News and other outlets reported that some of Scale’s high-profile clients, including OpenAI and Alphabet Inc.’s Google, began phasing out their engagements with the company.
Notably, OpenAI has reportedly turned to Mercor for more specialized data services, further intensifying the rivalry between the two firms.
As the race to dominate the AI frontier accelerates, the boundaries between competition and corporate espionage grow increasingly blurred.
