Power Play: Tinubu Clashes with EFCC Over Frozen Osun State Funds

President Bola Tinubu has issued a direct order to the Economic and Financial Crimes Commission (EFCC) to immediately vacate the court order freezing the bank account of the Osun State Government. In a statement released on Thursday, President Tinubu expressed deep concern and embarrassment over the timing of the EFCC's action, which occurred just days before the August 15 governorship election in the state. He emphasized that his embarrassment stemmed not from the EFCC carrying out its duties, but from the specific timing of the intervention.

The President has directed the EFCC to proceed without delay to court to vacate the freezing order and discontinue any related legal actions against the Osun State Government. He reiterated his commitment to allowing anti-corruption agencies to operate without political interference since taking office, stressing his belief that institutions should perform their duties within legal frameworks. While acknowledging he had not been fully briefed on the reasons behind the court order, President Tinubu deemed the timing inappropriate, warning that such actions by federal agencies could create an impression of federal interference in the Osun governorship election and undermine public confidence in the electoral process's integrity and fairness.

Conversely, the Economic and Financial Crimes Commission (EFCC) provided an explanation for its actions, stating that the account was frozen to halt the alleged movement of public funds connected to an ongoing investigation into approximately N11 billion in suspected financial misconduct. In a statement issued on Wednesday by its Head of Media and Publicity, Dele Oyewale, the commission responded to the Osun State Government's accusations of political targeting ahead of the August 15 election.

The EFCC detailed that its investigation into the state’s handling of Ecology Funds, Intervention Funds, and Federal Account Allocation Committee (FAAC) allocations commenced in March. The State’s Accountant-General and other officials had already been questioned as part of this inquiry. The decision to freeze the account was prompted by what the EFCC described as "unusual transfers" of funds from government accounts into various corporate entities, observed from August 2. The commission explicitly stated that while aware of the impending election, it had a responsibility to act swiftly to protect the sanctity of state funds, especially after noticing "huge transfers of funds into different corporate entities," which necessitated freezing the accounts to halt the trend. The EFCC firmly rejected claims that its actions were politically motivated and affirmed its mandate to ensure accountability, noting that Osun was not the sole state under investigation, as it monitors the finances of other state governments as well.

Earlier on Wednesday, the Osun State Government had vehemently criticized the EFCC's action. Governor Ademola Adeleke alleged that the EFCC intended to freeze state government and top officials' accounts to disrupt governmental activities before the election. The state’s Attorney-General and Commissioner for Justice, Oluwole Jimi-Bada, questioned the legality of the freezing order, arguing that the EFCC lacked the authority to freeze a state government’s accounts without adhering to due legal process. The state government consistently described the restriction as both unlawful and politically motivated, asserting it was designed to disrupt activities ahead of the governorship election.
