Following a week-long suspension influenced by the FCC, Jimmy Kimmel Live! made its highly anticipated return to the airwaves, though its full reach was immediately hampered by the actions of the Nexstar Media Group. Nexstar, which owns over 200 broadcasting affiliates across major cities and even a major network with The CW, decided to continue preempting Kimmel’s show with its own programming. This move effectively kept Jimmy Kimmel Live! off the air in a significant portion of the country, despite ABC's decision to end his suspension, raising concerns about the company's substantial influence on television programming.

To understand the motivations behind Nexstar's preemption of Jimmy Kimmel Live!, one can examine its previous programming shifts, particularly after its acquisition of The CW in October 2022. Upon and immediately following the sale, The CW canceled a staggering number of its original series, including popular shows from the Arrowverse like Batwoman and Legends of Tomorrow, and revamps such as Charmed and The 4400. A closer look at these cancellations reveals a troubling pattern: many of the axed series featured leads who were people of color or identified within the LGBTQ+ spectrum. While Nexstar and The CW attributed these cancellations to a strategic shift towards lower-cost programming, the perception was that the network was moving away from diverse representation. This notion was reinforced by the introduction of new shows like the Biblical drama The Chosen and the procedural Wild Cards, indicating a deliberate pivot towards an older, potentially more conservative audience. The impending end of All American, featuring a predominantly Black cast and the last remnant of The CW's pre-Nexstar era, further fuels this perception, seemingly contradicting the network's classic slogan, "Dare to Defy."

Adding to the challenges faced by Jimmy Kimmel Live!, Sinclair Inc., another prominent media giant, also announced its decision to preempt the show. Sinclair stated, "Beginning Tuesday night, Sinclair will be preempting ‘Jimmy Kimmel Live!‘ across our ABC affiliate stations and replacing it with news programming." This move is particularly significant as Sinclair boasts an even larger station footprint than Nexstar, operating 38 ABC affiliates. Sinclair itself has faced scrutiny, notably for a 2018 incident where multiple news anchors were required to read identical scripts, leading to accusations of violating journalistic ethics. While Nexstar has largely avoided controversies of that magnitude, its NewsNation cable network has been criticized for promoting right-wing views, contrasting with its self-proclaimed "fact-based and unbiased" news mandate.

The decisions by both Nexstar and Sinclair have been met with swift public backlash, including protests at their respective headquarters. The financial implications are also considerable; Disney, ABC's parent company, reportedly lost $4 billion in revenue during Kimmel's initial suspension. Consequently, Nexstar and Sinclair might anticipate a decline in viewership. The prevailing sentiment is that these media groups are echoing the approach taken by FCC Commissioner Brendan Carr, which initially led to discussions about free speech and censorship. As Kimmel himself eloquently stated upon his return, "This show isn't important — what's important is that we get to live in a country that allows us to have a show like this." Access to such programming and the ability for viewers to form their own opinions are crucial aspects of this freedom.

However, the preemption of Jimmy Kimmel Live! by Nexstar and Sinclair is not destined to be permanent. Both companies have affiliate agreements with Disney that are set to expire next year. To continue receiving vital revenue from advertising and programming, particularly from lucrative sports content supplied by the Disney-owned ESPN, Nexstar and Sinclair will likely be compelled to air Kimmel’s show before these agreements lapse. There is also the significant risk of alienating and losing long-term viewers, a detrimental outcome in an era where traditional broadcast television is experiencing a gradual decline. As Professor Danilo Yanich of the University of Delaware noted, viewers would be "ticked off" not only by the specific blocking of Kimmel's content but also by the broader implications for First Amendment rights. While Nexstar's influence on network television appears formidable, capable of reshaping The CW and temporarily sidelining a major late-night show, the financial power of a behemoth like Disney, and the potential for widespread viewer discontent, suggest that Nexstar's control may not be as absolute as it might seem. Jimmy Kimmel Live! continues to air weeknights on ABC at 11:35 p.m. EST.
