Nairobi Firm Files Case against Robert Alai over Alleged Illegal Occupation of Runda Property
Nairobi: An investment firm has filed an application seeking to block Kileleshwa Member of County Assembly (MCA) Robert Alai from occupying, leasing, or constructing on a contested parcel of land in the upmarket Runda Estate in Nairobi.

Cancer Investment Limited, through lawyer Harrison Kinyanjui, has lodged a petition before the Environment and Land Court seeking the court to issue a temporary injunction barring Alai and his associates from accessing or interfering with the property, which it claims to own legally.
In court documents seen by , Cancer Investment Limited accused Alai of leading a forceful invasion of the land while accompanied by individuals it described as 'goons and vagabonds', apparently assuming that the property in question was vacant and unoccupied.
The incident is said to have happened on March 31, 2025, at the property situated just next to the German School.
“The first defendant/respondent had ostensibly instructed his stated goons and vagabonds who were armed with crude weapons as averred above to force their way into the compound of the suit property, whereupon they proceeded to demolish the concrete pillar against which the gate to the suit property was grounded, thereby forcing their way into the suit property," court papers filed by Kinyanjui state.
The company, in court documents, also accused Alai and the aforementioned individuals of assaulting its director, Muhktar Parkar.
Muhktar is said to have sustained injuries in the confrontation and reported the incident at Runda Police Station under OB No. 31/03/2025.
In the petition, lawyer Kinyanjui insists that his client has been faithfully remitting land rates and all dues on utilities levied against the property by the service providers (Runda Water Ltd) as well as electricity.
Kinyanjui also claims that Cancer Investments Limited purchased the property from Transnational Bank of Kenya on 13th January 1992. Since then, the company has maintained possession of the land.
The company also stated that it has never entered into any transaction involving the property with Alai or any other party.

It further told the court that it had not offered the property as collateral nor relinquished the original title deed, which remains with Diamond Trust Bank of Kenya.
“Any lawful transaction involving the land would require a discharge of charge by the bank, which has not occurred,” Kinyanjui argued.
The firm contends that Alai’s alleged entry amounts to illegal trespass in violation of the Land Act and Article 40 of the Constitution, which guarantees the property right.
It wants the Gigiri Police Station’s Officer Commanding Station (OCS) to enforce any court orders that will be issued.
The matter will be heard on Monday, May 19, before Justice Mohammed Kullow.
Previously, reported that veteran broadcaster Fred Ombachi Machoka had issued a demand letter to Alai following a controversial statement he made about his health.
Machoka, through lawyer Danstan Omari, demanded an apology from the Kileleshwa MCA, failure to which he threatened to take legal action.
Alai is alleged to have made a controversial statement against the Radio Citizen presenter during an online spat.
