Former Kenyan Deputy President Rigathi Gachagua has launched a high-stakes legal challenge, demanding over Ksh 80 million in compensation following his 2024 impeachment.

The case, currently before the Milimani High Court, questions the legality of his removal and seeks financial restitution tied to his lost tenure.

His legal team argues that the impeachment process was unlawful and should either be nullified or financially remedied. The dispute is rapidly evolving into a defining constitutional test in Kenya’s political landscape.

Led by Senior Counsel Paul Muite, Gachagua’s lawyers are pushing for a comprehensive compensation package that includes unpaid salaries, allowances, and end-of-service benefits.

The issue also extends to lifetime privileges typically granted to former deputy presidents, such as security, medical cover, and staff support.

According to the filing, these entitlements were abruptly withdrawn following his removal from office. The legal team maintains that due process was compromised, particularly as proceedings continued during his reported hospitalization.

The Kenyan government, represented by the Attorney General’s office, has firmly opposed the claims, insisting that the impeachment followed constitutional procedures.

Authorities argue that once the Senate upheld the charges, Gachagua’s tenure and associated benefits legally ceased.

They also point to the appointment of Kithure Kindiki as his successor as conclusive proof that the transition of power was valid. This sets up a direct constitutional clash over the limits of executive accountability and post-office entitlements.

Beyond the financial stakes, the outcome of the case could significantly shape Kenya’s political future ahead of the 2027 elections. A favorable ruling for Gachagua may restore his political standing and reopen pathways for a comeback bid.
