California, Texas and Florida see the most auto insurance claims denied annually, according to an analysis of insurance claims nationwide by a Florida law firm.
Anidjar & Levine law firm says claim denials are a rising concern for drivers across the nation.
“When a claim is denied, policyholders face unexpected out-of-pocket expenses, adding stress to an already challenging situation,” the firm’s website says. “The frustration only deepens when drivers face setbacks that impact their daily routines, finances, and even their mental well-being.”
About 5% to 15% of all auto insurance claims are denied at some stage, the website says. It adds the denial rate can vary widely depending on factors such as policy type, the insurer and contract language.
California had 4,800 complaints for denial with other common issues being delayed payments and settlement disputes. Texas followed with 4,200 complaints with other issues being claim handling and low settlement offers. Florida was third on the list with 3,800 complaints. Other issues the state faces are fraud, uninsured drivers and delayed settlements.
Other states that round out the list include New York, Illinois, Pennsylvania, Georgia, Michigan, Ohio and North Carolina.
“For consumers, a denied claim can lead to significant financial strain,” the website says. “Florida drivers, for instance, may struggle to afford timely vehicle repairs, leading to missed work, school, or appointments. In states like Michigan, no-fault insurance can make coverage confusing, often resulting in higher premiums and frequent claim disputes.”
