The High Court intervened, ordering the government to produce businessman Phillip Aroko, who was arrested in connection with Were's murder, due to concerns over his detention without being arraigned. Aroko was later produced in court after a High Court order compelled police to account for his whereabouts. The State linked Aroko to the assassination, citing financial transactions and communication records, allegations Aroko denied.
Raila Odinga revealed that Were had confided in him about being trailed by suspicious individuals prior to his murder, describing an incident where Were, visibly shaken, sought a ride with him after a public event.
