₦3.1b fraud trial: Court to rule on Suswam's no-case submission July 23

Justice Peter Lifu of the Federal High Court in Maitama, Abuja, on Friday adjourned ruling on a no case submission filed by former Benue State Governor, Gabriel Suswam, and his former Commissioner for Finance, Omodachi Okolobia, to July 23, 2025.

Suswam and Okolobia are standing trial on an 11-count amended charge bordering on the alleged diversion of N3.1 billion, reportedly derived from the sale of shares belonging to the Benue State Government.

The shares were managed by the Benue Investment and Property Company Limited and sold through Elixir Securities Limited and Elixir Investment Partners Limited.

At the resumed hearing, counsel to the first defendant, Chenelu Ogbozor, and counsel to the second defendant, Paul Erokoro (SAN), informed the court of their application for a no case submission.

They told the court that the motion was filed on May 28, 2025, with a written address submitted and served on July 10, 2025.

The defence urged the court to uphold their submission and discharge and acquit the defendants on the grounds that the prosecution failed to establish a prima facie case.

Responding, the prosecuting counsel, Rotimi Jacobs (SAN), referred the court to the prosecution’s reply, dated July 2025, with an attached written address. He urged the court to dismiss the no case submission, describing it as lacking merit and substance.

Justice Lifu, after hearing both sides, reserved ruling and adjourned the matter to July 23, 2025.
