Immigration: How Psychological Evaluations Can Change Lives

Immigration attorneys and legal advocates play a crucial role in ensuring that their clients receive the strongest possible representation.

In the current political climate of the United States, immigration policies have become increasingly stringent, leading to heightened deportations and a pervasive atmosphere of fear among immigrant communities. As a first-generation American-born psychotherapist specializing in psychological evaluations for immigrants, I have witnessed firsthand the profound impact these policies have on individuals seeking asylum, protection under the Violence Against Women Act (VAWA), U-Visas, T-Visas or relief from extreme hardship.

I was raised by two educated Indian immigrants, who themselves experienced their own citizenship challenges over four decades ago. To address the current political challenges, I have initiated an Immigration Help Drive to support and safeguard immigrants in dire need of assistance.

My passion and commitment to this work began over eight years ago, when my private practice, Center of Inner Transformations, received its first referral for an immigration case. This client wore deep psychological scars due to severe persecution in their native country, and it became evident that a comprehensive evaluation could be pivotal in their legal pursuit of asylum.

This experience illuminated the critical role mental health professionals play in the immigration process, not only in documenting trauma but also in providing a voice to those silenced by fear and oppression. From that moment, I enrolled in a clinical training program for immigration mental health professionals and pursued advanced training by joining the non-profit organization Physicians for Human Rights to be at the forefront of the movement to help vulnerable immigrants.

: Individuals escaping persecution often suffer from conditions like Post-Traumatic Stress Disorder (PTSD), severe anxiety or depression. A detailed psychological assessment substantiates their claims by linking their mental health conditions to the traumas experienced in their home countries.

: Victims of domestic violence, regardless of gender, can seek legal status under VAWA. Evaluations help in documenting the types of abuse experienced and the related psychological impact, which is crucial for their petitions.

: Immigrants who have been victims of serious crimes in the U.S., such as robbery, sexual abuse or trafficking, may qualify for a U-Visa. Victims of human trafficking can apply for T-Visas. A psychological evaluation assesses the extent of the emotional and mental consequences of their experiences, aiding in their application process and claims for relief.

: Immigrants facing deportation can apply for waivers if it would cause extreme hardship to their U.S. citizen or lawful permanent resident family members. Psychological evaluations provide evidence of the emotional and psychological impact of potential deportation, strengthening their case.

Through comprehensive psychological evaluations, we not only aid in legal processes but also affirm the humanity and resilience of those seeking a better life.
