EXCLUSIVE! Jenelle Evans' Case Against Ex David Eason for Restraining Order Violations Dismissed; Judge Rules David's October Visit to The Land Was Not Violation

 did not get the day in court she had hoped for on Friday. 

can exclusively reveal that a judge dismissing both of the fired  star’s restraining order violation charges she had filed against her estranged husband , stemming David’s visit to the couple’s property on back in October. 

The Ashley’s sources tell her that Jenelle flew to North Carolina from her home in Las Vegas (again!) to attend the hearing at 9:30 a.m. on Friday. Less than an hour later, though, the judge in the case had signed off to dismiss both charges against David.

“Jenelle was not happy,” one source tells The Ashley.

As The Ashley previously told you, David— along with his girlfriend  and several others— visited The Land in October and attempted to retrieve property including motorbikes, tools and equipment. David— who currently has a protective order against him from Jenelle and is, therefore, not allowed on The Land— was actually escorted by a cop, who was told he was there to supervise as David retrieved property from the shed. Jenelle was alerted to what was going on via her Ring cameras and called the Sherriff’s Office, informing him of the protective order and the situation. The Sherriff then ordered the on-scene Deputy to stop David & Co. from loading up anything else and made David return everything but his tools. 

Jenelle then filed violation charges on David, resulting in him being arrested in November for violating the restraining order and trespassing.

“Once the judge saw the paperwork from the night, and saw that David had been authorized by the cops to be on The Land and had even brought one with him, due to the restraining order in place, the judge dropped the charges,” The Ashley’s court source stated. “David had made multiple calls to authorities that night, and that was on record, and informed them there was a restraining order in place, but that Jenelle was not at the home and is living in Nevada and he was authorized [to go onto The Land] by the cops.” 

As The Ashley previously reported, David was assigned a public defender for this case, as it is a criminal case. 

Court records obtained by The Ashley also confirm the dismissal.

A “Voluntary Dismissal Without Leave by a District Attorney” (VD) was issued for both charges, meaning that the dismissal should be permanent; however, the DA can technically recharge David within the next two years before the Statue of Limitations has expired. This is very unlikely and rarely if ever happens, so a “VD” almost always means the case is done. 

Jenelle, wondering which ex she can file charges against next…probably. 

No plea agreement was made. However, the restraining order that Jenelle has against David appears to still be active. However, the ankle monitor that David has been required to sport for the last few months will likely be taken off. 

Jenelle had hinted on social media in recent months that she planned to file more violations charges against David, as she felt that he has violating the restraining order. (She also threatened to file charges against Kenleigh.) During one instance, Jenelle stated that she felt it was a violation of the order that David’s daughter Maryssa, as well as Kenleigh, had mentioned Jenelle on social media

The Ashley can confirm that, as of press time, no additional charges have been filed against David, and none have been filed against Kenleigh.

David still has several active court cases, though. In addition to the divorce and custody civil case with Jenelle, he is also due in court next month for a hearing in his Superior Court criminal case for child abuse and assault by strangulation, stemming from his alleged strangulation of Jenelle’s oldest son Jace in September 2023. 

Jenelle has yet to comment on Friday’s hearing.
