Commission launches consultation on the revision of the Recommendation on relevant markets | Shaping Europe's digital future

The Commission launched a targeted consultation on the review of the Recommendation on relevant markets in the electronic communications sector adopted in December 2020 (2020/2245).

The Commission is considering reviewing the current Recommendation to take into account major market and technological developments such as the deployments of 5G networks, the convergence between different types of networks and services and the deployments of fibre networks. The review will also reflect on the overall observed and expected market trends in the Member States.

One of the objectives of the current regulatory framework is to progressively reduce ex ante sector-specific rules as competition in the markets develops and, ultimately, to rely on competition law. It is thus necessary to periodically assess if the currently recommended markets continue to display such market characteristics that justify continued imposition of ex ante regulatory obligations or if there are other markets that should be included in the list. For this reason, the European Electronic Communications Code further stipulates that the Commission shall review the Recommendation regularly.

The aim of the consultation is to collect evidence on the state of play and developments of wholesale markets and the position of BEREC, national regulatory authorities (NRAs), electronic communications operators and services providers, industry associations, individuals. This is to enable the Commission to assess whether, and if yes to which extent, the current list of relevant markets should be subject to a revision.

This review is conducted in parallel to the preparation of the Digital Networks Act (DNA) proposal and it is based on the current framework. A separate and dedicated call for evidence on the DNA has been launched on 6 June 2025. The evidences and data gathered in this process may also be used for grounding the DNA proposal.
