MultiChoice Executives Arraignment Over Alleged FCCPC Act Breach

The Federal High Court in Abuja has set October 7, 2025, as the date for the arraignment of key officials of MultiChoice Nigeria Limited, including Chairman Adewunmi Ogunsanya and Managing Director/Chief Executive Officer John Ugbe. The charges against them stem from alleged breaches of the Federal Competition and Consumer Protection Act (FCCPA), 2018. Justice James Omotosho fixed the new date following an application from Chizenum Nsitem, counsel for the Federal Competition and Consumer Protection Commission (FCCPC), who cited the absence of the defendants due to improper service of court documents.
Alongside Ogunsanya and Ugbe, six other senior officers of the Pay-TV company, as well as MultiChoice Nigeria Limited itself, are expected to be arraigned. These individuals include Fhulufhelo Badugela, CEO of MultiChoice Africa Holdings; Retiel Tromp, Chief Financial Officer, Africa; Keabetswe Modimoeng, Group Executive for Corporate Affairs; director Adebusola Bello; Fuad Ogunsanya; and Gozie Onumonu, Head of Regulatory Affairs and Government Relations. The prosecuting agency's lawyer requested an adjournment to ensure proper service of the court documents, including the hearing notice, on all defendants.
The charge, designated FHC/ABJ/CR/197/2025, was dated and filed on May 26. It encompasses a total of seven counts against the defendants. Specifically, count one alleges that MultiChoice Nigeria Limited, on March 6, at its premises in Asokoro, Abuja, failed to appear before the FCCPC without sufficient reason, in non-compliance with a lawful summons issued on February 25. This alleged act is considered an offense contrary to and punishable under Section 33 (3) of the Federal Competition and Consumer Protection Act, 2018. The upcoming court date on October 7 is set for the defendants to formally enter their plea in response to these accusations.
