Lawyers File Petition to Remove Ahmednasir From Senior Counsel Roll

Published 1 month ago2 minute read

City lawyer Ahmednasir Abdullahi is facing a fresh uphill task as two lawyers have filed a petition seeking to remove him from the Roll of Senior Counsel over alleged professional misconduct.

Among the misconduct allegations that Ahmednasir faces are the persistent attacks on the Judiciary.

In the petition, lawyers Paul Kiragu Wathuta and John Murimi Njomo argue that Ahmednasir has consistently engaged in actions that are highly discrediting for a person of his legal stature, as they invoked Rule 4(c) and Rule 15 of the Advocates (Senior Counsel Conferment and Privileges).

The petition particularly takes aim at Ahmednasir's consistent tirades on social media, especially on X (formerly Twitter), which they argue are meant to malign and discredit the judiciary.

Multiple instances were referenced in the petition where Ahmednasir allegedly made 'unsubstantiated' allegations against judges. The lawyers claim that warnings have been issued to the senior counsel, but he has failed to heed them and “has become more emboldened, doubling down on his arbitrary attacks.”

Ahmednasir was conferred the title of Senior Counsel in December 2012 and has since represented some big names in Kenya.

However, the two lawyers want the lawyer's title stripped, arguing that such a title should be reserved for legal minds who exhibit professionalism.

The petition comes just days after Ahmednasir and a fleet of other lawyers working under his firm filed a separate petition seeking the removal of seven Supreme Court judges from office.

The seven justices—Chief Justice Martha Koome, Philomena Mwilu, Justice Mohamed Ibrahim, Dr Smokin Wanjala, Njoki Ndung'u, Isaac Lenaola, and William Ouko—were accused of gross misconduct, with Ahmednasir's team citing Article 168 (1) of the Constitution of Kenya.

Ahmednasir's petition against the Supreme Court judges was a counter-attack to the court's decision on 18 January barring his team from making submissions before the court.

The Supreme Court argued that the decision to bar Ahmednasir came after the lawyer "relentlessly and unabashedly scandalised and ridiculed" the court.
