Delhi HC Dismisses Plea Against Chirag Paswan's Election

The Delhi High Court has dismissed a petition challenging Chirag Paswan's election as a Member of Parliament (MP) from the Hajipur Lok Sabha seat in Bihar, citing a lack of territorial jurisdiction. The petitioner, a survivor of sexual assault, alleged that Paswan concealed criminal antecedents related to a case involving Prince Raj.
Justice Amit Bansal stated that because the election was held in Bihar, the Delhi High Court does not have the authority to adjudicate the election petition. The court dismissed the petition on the grounds of lacking territorial jurisdiction but allowed the petitioner to pursue other legal remedies.
The petitioner claimed the sexual assault was committed at the "insistence" of Prince Raj and his associates, including his cousin Chirag Paswan. She further alleged that Paswan failed to disclose this "criminal antecedent" when filing his nomination for the election. The petitioner argued that filing a false affidavit or concealing information about criminal cases violates Section 125A of the Representation of the People Act, which is punishable with six months imprisonment.
Advocate Sidhant Kumar, representing the Election Commission of India, argued that the election petition was not maintainable in Delhi because the election took place in Bihar, as per the Representation of the People Act.
