A CCTV footage retrieved from a petrol station has implicated Julius Mugoi in the murder of former Treasury official Tom Osinde.

On Thursday, John Safari, a forensic expert, testified in court that the footage captured Osinde's vehicle being fuelled at Ngata petrol station in Nakuru.

Julius Mugoi, according to Safari, was the one driving the vehicle on June 18, 2023.

Mugoi is accused of  killing Osinde on the night of June 17 and 18, 2023, at his Ngata Farm in Rongai, Nakuru County.

He testified that in July 2023, he was instructed by the officer attached to the Directorate of Criminal Investigations Homicide Unit to process and analyze CCTV footage of a vehicle fueled at the Rubis Petrol Station.

He said he retrieved the footage on July 1, 2023.

“I visited Rubis Petrol Station in the company of homicide detectives and retrieved the CCTV footage, short files of the CCTV video captured on June 18, 2023, between 2 pm and 5 pm,” Safari said while testifying before Judge Julius Nangea.

In the videos, he said he had developed 16 still photographs.

On Sunday, June 18, 2023, at 3.37 p.m., CCTV cameras captured the alleged car driven by Mugoi moving and stopping at Ngata Petroleum.

From 3.40 p.m. to 3.43 p.m., CCTV cameras captured a fuel attendant attending to the vehicle as the accused is seen alighting from the car and conversing with the attendant.

The accused checks the vehicle booth and then holds the driver’s door.

CCTV cameras also captured the accused allegedly leaving Ngata Petrol station at 3:45 p.m.

“The analysis above led me to conclude an opinion that the accused person was captured with the deceased vehicle and positively link the accused person to the crime,” he said.

He indicated that his consideration was based on his cognitive functioning and observations made during playback analysis.

Osinde's decomposed body was found in the Kuja River in Migori County on June 28, 2023.

Prosecution remains with 29 witnesses to testify.

The case will be further heard on May 20.
