Supreme Court Adjourns Injunction Application Against Removal of Chief Justice Indefinitely

Accra, April 9, 2025 - The Supreme Court has indefinitely adjourned an application seeking to halt the process potentially leading to the removal of the Chief Justice. This development arose from a case filed by Vincent Ekow Assafuah, the Member of Parliament for Old Tafo, who is contesting the constitutionality of the impeachment proceedings and seeks an injunction to suspend the process until his writ is determined.

The five-member panel of the apex court, presided over by Justice Henrietta Mensa-Bonsu, announced the adjournment following a request from the Attorney-General's Office. The Attorney-General had previously communicated to the Chief Justice requesting an adjournment for all cases involving the Attorney-General’s office during the week, citing a conference of State Attorneys in Accra.

In court, State Attorney Reginald Odoi reiterated the Attorney-General's request, emphasizing the respect for the court. However, Godfred Yeboah Dame, former Attorney-General and counsel for the applicant, questioned the absence of the Attorney-General or his deputy, labeling it “odd” given the constitutional importance of the case. He expressed concern that a conference of state attorneys would take precedence over such a critical matter. Dame urged the court to reschedule the hearing to the earliest possible date, suggesting Monday.

Justice Mensa-Bonsu clarified that the court could not independently set a new date, as the Attorney-General's request was directed to the Chief Justice. The case will now be returned to the Chief Justice to determine a new hearing date, with the adjournment being sine die.

In related details emerging, the adjournment was specifically linked to the Attorney General's request for a postponement of all cases involving his office from April 7 to April 10, due to ongoing training for lawyers. It was also noted that two state Attorneys, one a former Personal Assistant to Godfred Dame, attended the court to formally request the adjournment.

Godfred Dame highlighted his surprise that Attorney General Dr. Dominic Ayine and his deputy, Dr. Justice Srem-Sai, would prioritize a training workshop over this case. He reiterated his plea for an expedited hearing, suggesting April 14. The core of the plaintiff's argument revolves around the constitutionality of the President consulting the Council of State on the determination of a Prima Facie case without first seeking the Chief Justice’s response.

Despite these arguments, Justice Henrietta Mensah Bonsu upheld the decision to adjourn the case indefinitely, pending further direction from the Chief Justice.
