submitted an emotional declaration in court as he works to convince a Los Angeles judge to toss his former fiancée’s custody lawsuit, In Touch can exclusively report.
On May 16, the musician, 29, submitted the declaration as part of the case brought by his ex, .
As In Touch previously reported, Jamie filed a petition on April 16 in L.A. court.
The filing asked for full custody of the 2-year-old daughter she shares with the entertainer. She requested they share legal custody.
The child was identified as “DDP” in the court documents.

Jamie said the child lived with her and Post between birth and November 2024. TMZ reported that the musician filed a separate suit against Jamie in Utah.
He claimed he lived in the state and the child was raised there. A source told TMZ that Post believed Jamie moved to L.A. in hopes she would be awarded a bigger child support award than she would be in Utah.
Now, in his declaration, Post slammed Jamie’s moves in court and argued the case should be heard in Utah, not California.
He claimed, “I am a resident of Utah and have been since 2019.” He admitted DDP was his child, born in 2022. Post said Jamie is originally from California, but she moved into his Utah home after they started their relationship in early 2022, around the time their baby was born.
“Jamie remained in Utah living with me from January 2022 until January of 2025. From January of 2022 until January of 2025, Jamie did not have a home or an apartment in California because she was living in Utah,” he said.
Post explained, “Jamie only recently moved to Los Angeles. In November or December of 2024 when it was clear that our relationship had ended Jamie told me she wanted to move to Los Angeles.
At the time we were sharing custodial time with DDP in an agreed “nesting” arrangement in our home in Utah.”
The musician added, “We initially alternated weeks of custody with the custodial parent staying with DDP in my main home in Utah where DDP has lived for her entire life. After sharing custody for alternating week periods of time, we increased the custody time to alternating 10 day periods of time.”
Post said Jamie after a couple of weeks of sharing custody in Utah under the “nesting” agreement, he said Jamie told him she wanted to move to L.A.
He told the court, “We discussed her moving and that we would continue to share custody of DDP using a two week alternating custody schedule. There was not a discussion about DDP moving to California.”
Post continued, “I agreed to financially assist Jamie with her move to Los Angeles paying to move her belongings from our home in Utah to Los Angeles. I agreed to do so to maintain our co-parenting relationship in a peaceful and cooperative manner.”
He added, “I also agreed to be the guarantor on Jamie’s Los Angeles apartment lease so she would qualify for a safe place to live and DDP would be safe when she was in Jamie’s custody.”
The musician said Jamie moved into an apartment in January.
He noted, “With the move to Los Angeles, I also agreed to pay to ship the two automobiles that Jamie drives which are both registered in the State of Utah and have Utah license plates. The automobiles were shipped to Los Angeles with all of Jamie’s other belongings in January of 2025.”
Post admitted their child was born in L.A. but explained it was “because Jamie and I decided that we wanted to have a doctor there manage and oversee Jamie’s prenatal care, and for DDP to be delivered by the doctor we selected.”
He added, “In addition, Jamie’s parents live in the Pasadena area and Jamie wanted to have her mother close by for the delivery.”
Post alleged, “In August of 2022 when DDP was almost three months old, Jamie and I returned to our home in Utah. DDP has spent her entire three years of life living in Utah.”
In his filing, Post explained he has a nanny for DDP, who has taken care of the child since they were 3 months old. He said the nanny travels with him when he is out of town.
“DDP has a very strong bond with [the nanny]. [The nanny] lives in Utah,” Post said. Post added that DDP has been enrolled in a ton of classes and school in Utah.
He added, “Since Jamie moved to Los Angeles, she has rushed to enroll DDP in every type of activity she can in order to mislead the Court to believe that DDP has lived in California and not in Utah. In addition to enrolling DDP in activities in Los Angeles, I recently learned that Jamie enrolled DDP in a full-time day care facility.”
Post said he filed his case in Utah before Jamie filed her suit in California. He claimed she has misled the court.

Post told the judge, “I understand that Jamie may eventually establish legal residency in California once she meets the legal requirements. However, I do not consent to Jamie’s back door attempt to change DDP’s residence from Utah to California.”
He ended, “I request that the California Court admonish Jamie for her lack of candor, gamesmanship in attempting to forum shop, and her intentional action to try to mislead the court about DDP’s home. I further request that the California court dismiss the California Petition with prejudice and find that Utah is DDP’s home state and the proper jurisdiction to decide parentage and make custody orders.”
As In Touch previously reported, Post and Jamie ended things in 2024. The musician moved on to his new girlfriend, Christy Lee, who he started dating in 2025.
