PCEA leaders clash over contempt charges in treasurer dispute

Contempt of court charges against PCEA Secretary General and Moderator have deepened following accusations of misleading delegates about a court order barring a treasurer’s installation.
Maguga Parish Moderator Rev. Ndegwa criticised the Secretary General for misrepresenting a court order that prevented David Ndumo’s installation as Honorary Treasurer.
The Secretary General told the assembly that the court had stopped him from participating, but Rev. Ndegwa argued the order applied to both him and Moderator Muhi, not just the Secretary General.
“It is unfortunate that the Secretary General would give information that it is him who was told by the courts not to induct the Honorary. The order isn’t personal, it’s for you and the Moderator of the General Assembly,” Rev.
Ndegwa said in a video shown before Civil Division’s Lady Justice Stella Mutuku.
The video, presented by plaintiff’s lawyer Andrew Mochu, was intended to support the contempt allegations brought by Benjamin Njoroge Mburu, a church member.
It showed the Secretary General admitting to receiving court orders but attempting to justify his actions to the assembly, suggesting Moderator Muhi was prepared to face consequences for proceeding with the installation.
The video also showed tensions between church leaders, with Rev. Timothy Njoya walking out of the assembly after Moderator Muhi denied a point of order that would have allowed a physical court service.
Moderator Muhi denied being served with court papers, despite the process server testifying that he was served via WhatsApp after Muhi switched off his phone.
Earlier, the two church leaders clashed in court over whether the Secretary General had participated in the installation, with Rev. Muhi questioning who was lying.
Mburu had sought an urgent court order to stop the installation, citing Mr. Ndumo’s failure to repay a Sh5.3 million loan to Sheri SACCO, which caused financial distress for 15 guarantors.
He argued that someone unable to fulfil financial obligations was unfit for the role of Honorary Treasurer.
Justice Mutuku set June 25 for the next hearing.
