Nigerian High Court Asks Correctional Centre To Bring Ohanaeze Leader Igboayaka From Custody, Stops Police From Re-Arresting Him

The court also prohibited the police or any other law enforcement agency from torturing Igboayaka.

The Federal High Court sitting in Abakaliki, Ebonyi State capital has ordered the Abakaliki Custodial Centre of the Nigerian Correctional Service to produce Igboayaka O. Igboayaka, the President of the Ohanaeze Youth Council before the court on Wednesday, March 12, 2025.

Ruling in a submission by his legal team during court proceeding on Friday, the trial judge, also granted a restraining order against the police from rearresting Comrade Igboayaka.

The court also prohibited the police or any other law enforcement agency from torturing Igboayaka.

This development has sparked optimism that Igboayaka may be granted bail or discharged and acquitted on Wednesday. 

Igboayaka's arrest had brought widespread concern, with the Ebonyi State Police Command initially denying reports of his abduction, claiming instead that he was arrested following a petition accusing him of disseminating false information.

The Ohanaeze Youth Council had expressed gratitude to supporters and solidarity groups, emphasising the importance of this case in upholding the rights to freedom of expression as enshrined in the 1999 Constitution of the Federal Republic of Nigeria.

"We are now much sure that Comrade Igboayaka will be granted bail or discharge and acquitted on Wednesday 12th March, 2025.

"We thank everyone of you that has showed support and solidarity in the course of this struggle to enforce the Rights to Freedom of Expression as enshrined in the 1999 Constitution of the Federal Republic of Nigeria," Ohanaeze Youth Council has expressed in a statement made available to SaharaReporters on Friday.

The case is between comrade Igboayaka vs Governor of Ebonyi State, the Commissioner of Police, the Attorney General, and the AK Unit Commander.
