Nick Carter's Accuser Drags His Late Brother Aaron Into Court Battle | In Touch Weekly

’s sexual assault accuser demanded the Backstreet Boys star turn over documents in his possession from his late brother, Aaron Carteras part of their ugly court battle, but he said he has nothing to produce, In Touch can exclusively report.

The pop star, 45, filed court documents, obtained by In Touch, which revealed Melissa’s demand and his accusations against her that she failed to turn over emails and other discovery in the case.

Nick accused Melissa, 40, of dragging her feet on producing documents he requested and refused to turn over certain items until a protective order was entered.

His lawyer noted, “Many of the documents/information [Melissa] refused/refuses to provide until a protective order is entered were previously disseminated to the public by [Melissa] herself.”

The lawyer alleged, “[Melissa] has engaged in a protracted series of tactics aimed at interfering with, delaying and otherwise impeding [Nick’s] ability to discover this case. [Melissa’s] instant lawsuit was filed on April 11, 2023, over two years ago.”

Nick claimed Melissa has turned over zero documents from the 71 request for productions he made.

His lawyer said, “[Melissa’s] false promises in connection with extensions, tactics in passing the ball from one law firm to the next, failure to participate in discovery on any meaningful level and disingenuous objections to [Nick’s] legitimate discovery evidence her bad faith and goals of delaying this litigation.”

In one request, Nick asked Melissa to turn over any emails, letters, texts or messages or recordings between her and any other person relating to her claims Nick sexually assaulted her.

For her part, Melissa accused Nick of failing to turn over documents she requested from him.

One of her requests included asking Nick to turn over documents from Aaron related to Melissa that are in Nick’s possession.

Aaron died on November 5, 2022, at the age of 34. Nick and his brother had a rocky relationship for years.

In a letter from Nick’s lawyer to Melissa’s team, they scoffed at the request for documents from Aaron.

“The documents [Melissa] contends [Nick] failed to produce (‘documents from Aaron Carter including relationship with [Melissa],’ … are nothing more than the evidence she pretends exist to bolster her claims. These documents do not exist anymore than ‘documents evidencing [Melissa’s] vacation to Mars.'”

Nick previously claimed that his late brother spoke Melissa before his death.

Nick claimed Melissa and another one of his accusers took advantage of Aaron’s “fragile condition” when he was estranged from him.

Nick claimed that Aaron eventually cut off contact with the accusers and apologized to him for his behavior. A hearing on the matter has been set for later this month.

As In Touch previously reported, Melissa sued Nick over an alleged sexual assault at a Santa Monica, California, apartment in 2002. She claimed she was 18 and Nick was 22.

Melissa, who was a former member of the girl group Dream, claimed Nick took her virginity despite her objections.

The suit claimed, “[Melissa’s] roommate and childhood friend and [Nick’s] friend were in the apartment in Santa Monica the night [Nick] sexually assaulted [Melissa]; and right after the assault, [Melissa] informed her manager (who made arrangements to keep [Melissa] away from [Nick] while on set), her roommate, her mother and another actor.”

Melissa filed a police report in 2017, but no charges were ever brought against Nick.

For his part, Nick denied all allegations of wrongdoing. He accused Melissa, her father and another accuser named of conspiring together to shake him down for money.

Nick believed Melissa and her father coached Shannon and had her make false allegations.

The trio denied the claims. The parties have been fighting in Nevada court for over a year.

As In Touch first reported, back in July 2024, Nick filed a $2 million lawsuit against Melissa accusing her of causing him emotional distress due to the fabricated assault claims.

The suit, filed in California, claimed Nick had lost a ton of business deals due to Melissa’s alleged falsehoods. Nick was adamant that the sexual encounter the two had in 2002 was “consensual.”

“After having consensual sex, [Melissa] and [Nick] fell asleep. [Melissa] slept next to [Nick] through the night. The four woke up together, exited the apartment together and walked out to the parking garage together,” his suit alleged. “At no point in time did [Nick] sexually assault [Melissa] or any other person.”

The Backstreet Boys star claimed Melissa brought the claims against him after her career stalled out.

“Melissa’s dwindling acting career came to an end in 2015 after her performance in a movie entitled Actress(es): A Web Series. Prior to the foregoing film, she had not appeared in any movie or television show since 2005; nor has she appeared in any since,” the suit claimed.

He said Melissa first made her accusations against Nick in a 2017 blog post.

Nick also took issue with Melissa appearing in a 2024 documentary called Fallen Idols: Nick and Aaron Carter. He said Melissa falsely accused him of assault in the documentary and other media interviews.

The suit read, “The statements [Melissa] made as well as her contributions to the Ish Entertainment ‘documentary’ indicating that [Nick] was/is a rapist and that she was raped by [Nick] were/are false and constitute slander per se.”

Nick claimed Melissa’s alleged lies cost him a $350,000 deal with MeUndies, a $1 million deal with Vrbo, a brand partnership with The Children’s Place for $125,000 and various other endorsement deals.

He demanded $2.5 million in damages, along with unspecified punitive damages and attorneys fees. Melissa denied all allegations of wrongdoing.
