MCA Grace Nduta Faces Legal Proceedings Over Alleged Abduction in Kenya

Kanyenyaini Ward Member of County Assembly (MCA) Grace Nduta, Juja CDF Chairman Peter Kiratu, and two other individuals, David Macharia Gatana and Cyrus Kieru Muhia, have been implicated in the alleged stage-managed abduction of Juja Member of Parliament George Koimburi. The Directorate of Criminal Investigations (DCI) is investigating the incident, suspecting a plot that may have included an intent to murder and an attempt to mislead law enforcement by providing false information.

The suspects were arraigned following their arrest on May 28, 2025, and were held at Capitol Hill, Industrial Area, and Muthaiga Police Stations. The prosecution initially requested the detention of MCA Nduta for 14 days and the other three suspects for 15 days to allow for ongoing investigations. However, defense lawyers opposed this, arguing for their clients' release on bail and asserting that their freedom would not impede the DCI's probe. Ultimately, Magistrate Caroline Nyaguthii Mugo ruled in favor of the suspects, releasing them on a Sh1 million bond or a cash bail of Sh300,000 each. The magistrate determined that the DCI had not presented compelling reasons to justify their continued detention. As part of their bail conditions, the four are barred from contacting key witnesses, including MP Koimburi, and are required to report to DCI detectives on a weekly basis.

An affidavit presented by Chief Inspector Nicholas Njoroge of the DCI Headquarters Operations Support Unit alleged that MCA Nduta, Kiratu, Gatana, and Muhia orchestrated the kidnapping of MP Koimburi "with the intent to murder." They are also accused of creating a disturbance and providing false information to a public officer regarding the incident.

The initial report of the abduction was made on May 25, 2025, by Peter Kiratu at Mugutha Police Station. Kiratu claimed that MP Koimburi had been abducted by two unknown men wearing blue masks and driven away in a Subaru Forester after attending a service at the Full Gospel Ebenezer Church in Mugutha. Investigations later identified the vehicle's registration as KDG 803B, a car registered to Cyrus Kieru Muhia, one of the suspects. Contradicting the abduction claim, the DCI also stated that on the night Koimburi was allegedly abducted, MCA Nduta had spent the entire night with him at a bar in Gatundu South. Furthermore, police confirmed that CCTV cameras at the church premises had captured the events of that day.

Adding another layer to the case, the DCI revealed that MP Koimburi had reportedly evaded arrest just two days prior to the alleged abduction, on May 23, 2025. This occurred at a public function at Gachororo Primary School where DCI officers were present to arrest him in connection with a land fraud case involving parcel RUIRU EAST/JUJA BLOCK2/76796. Koimburi allegedly fled on a motorcycle with the help of an unknown rider, abandoning his Toyota Prado (registration KDQ 854J) and his driver. The driver was subsequently interviewed and released by the DCI, while the vehicle remains in their custody. The Office of the Director of Public Prosecutions (ODPP) had, on May 20, 2025, directed that Koimburi be charged with obtaining registration by false pretence, conspiracy to defraud, forgery, and uttering false documents. It was also reported that after evading arrest, Koimburi met with Juja CDF Chairman Peter Kiratu to discuss plans to retrieve his seized vehicle.

The DCI noted that amateur videos of the alleged kidnapping quickly circulated on social media, causing public panic among the MP’s constituents, colleagues, family, and friends. However, preliminary investigations by the DCI contradicted Kiratu’s initial report. Investigators have so far been unable to obtain a medical report or record a statement from MP Koimburi, as he is reportedly hospitalized in critical condition and deemed unfit for questioning.

The DCI had strongly argued against granting bail to the suspects. Their reasons included the seriousness of the allegations involving a sitting Member of Parliament, the unclear motive behind the alleged abduction, potential interference with ongoing investigations, and the risk to public order in Juja. They also highlighted the need for forensic analysis of seized electronic gadgets and expressed concerns about the possible involvement of other unidentified suspects. Additionally, the DCI raised concerns for the suspects' own safety due to public outrage. In response, the suspects, through their lawyers, opposed the DCI's application, claiming it was ill-motivated and amounted to a political witch-hunt. They asserted their willingness to cooperate fully with the investigation and comply with any conditions set by the court.
