Appeal Court Upholds Kano Local Government Election Results and KASIEC's Composition

The Kano State Government has expressed its strong approval of a recent Court of Appeal judgment that validated the conduct of the local government elections held in the state. In an official statement, the government hailed the verdict as a significant triumph for democracy, the rule of law, and the collective will of the citizens of Kano State. The statement, issued by Comrade Abdullahi Waiya, the Commissioner for Information and Internal Affairs, emphasized that this judicial decision underscores the commitment of Governor Abba Kabir Yusuf and the Kano State Independent Electoral Commission (KASIEC) to conducting credible, free, and fair elections.

Governor Abba Kabir Yusuf extended his commendations to the judiciary for its demonstrated courage, fairness, and dedication to upholding constitutional order. He also expressed appreciation for the citizens of Kano State, acknowledging their calmness, resilience, and patience throughout the legal proceedings. According to Commissioner Waiya, this collective display of maturity is reflective of the high level of political awareness and the robust democratic spirit prevalent in Kano State. The government reaffirmed its unwavering commitment to fostering grassroots development and pledged continued support for the democratically elected local government councils to ensure the delivery of democracy's benefits to the populace.

The pivotal Court of Appeal ruling, delivered on a Friday by a three-member panel, overturned a prior judgment by a Federal High Court in Kano. The Federal High Court's decision had nullified the composition of the Kano State Independent Electoral Commission (KASIEC) and consequently voided the local council election conducted by KASIEC on October 26, 2024. The appellate court, presided over by Justice Biobele Abraham Georgewill, decisively held that the Federal High Court did not possess the jurisdiction to adjudicate on matters concerning the composition of state electoral bodies or the qualifications of their members.

In its judgment, the Court of Appeal allowed three separate appeals lodged by the Kano State Attorney General, the Kano State House of Assembly, and KASIEC itself. Consequently, the suits initially filed before the Federal High Court, from which the annulled judgment originated, were struck out due to a lack of jurisdiction. The Court of Appeal clarified that the appropriate judicial body with the requisite jurisdiction for such matters is the High Court of Kano State. Furthermore, in a distinct fourth judgment on the same day, the Court of Appeal also reversed another decision by the same Federal High Court in Kano. This second reversed judgment had previously rejected the list of candidates submitted by the Musa Kwakwanso faction of the New Nigeria People’s Party (NNPP) to KASIEC for the aforementioned local government election.
