Read Kyle Richards' Ex Mauricio's Court Testimony in Family's Fight With 81-Year-Old Dad's Ex-Girlfriend
’ estranged husband testified under oath as part of his family’s effort to obtain a restraining order for his dementia-stricken father, In Touch can exclusively report.
In Touch obtained a transcript of the May 5 hearing, where Mauricio, 54, answered questions about his father, .
In October 2024, Mauricio’s sister, , filed a petition for an elder adult abuse prevention restraining order on behalf of Eduardo, 81, against Eduardo’s longtime partner, .
Kyle Richards and Mauricio Umansky.
Sharon, who has her own restraining order in place against Simin, accused her father’s girlfriend of being “abusive” to him. Simin denied the accusations and accused Eduardo of being the abusive one.
She asked the court to grant her a restraining order against him. The two have been going back and forth in court for months.
A decision has yet to be made on the matter despite several hearings.
At the recent hearing, Mauricio’s mother, , was present in the courtroom. She told the judge she was the mother of Mauricio and Sharon and Eduardo’s former wife of 30 years.
While under oath, Mauricio explained he is the CEO and founder of the real estate company The Agency, which Eduardo has worked at as an agent.
Mauricio explained the real estate agents who work at his firm usually are paid 80 percent on a sale and the rest goes to The Agency.
Mauricio said it had been over 18 months since his dad sold his last home. Simin’s lawyer objected after Mauricio was asked how much Eduardo was paid in 2023 from The Agency.
Sharon’s lawyer explained the question was relevant because Simin testified that the money that Eduardo paid to her was a share of his commissions.
Sharon’s lawyer said they believe received $124,000 in 2023 and $156,000 in 2024 from Eduardo, which they argued is evidence of alleged financial abuse. Simin testified at a previous hearing that the money was commissions owed to her because she worked with Eduardo selling homes.
Mauricio told the court his father earned around $35,000 in commissions in 2023. A tax form was presented in court showing Eduardo earned $39,823.69 in commissions in 2024.
In court, Mauricio said Simin used to work for The Agency but no longer did. He said her time with his company ended in early 2024.
During cross-examination, Simin’s lawyer grilled Mauricio about Eduardo and Simin’s relationship.
Mauricio explained that within The Agency, his daughter served as president of The Umansky Team. He said Eduardo worked under The Umansky Team, as did he.
He said Simin was given “courtesy permission to work for The Umansky Team as she was my father’s girlfriend, but she did not work for The Umansky Team. She had it as a title, but she never earned commissions or was paid the way we paid The Umansky Team.”
Mauricio also revealed Eduardo owns four percent of The Agency.
Simin’s lawyer grilled Mauricio on whether Eduardo was paid any compensation due to his ownership. Mauricio denied Eduardo was paid any dividends and said The Agency had to deal with a slow real estate market for the past couple of years.
“[Eduardo] made an investment in The Agency at the beginning. The last three years, the real estate brokerage has been under the lowest at the tremendous housing recession. The last three years, we’ve had the lowest amount of transactions in the markets ever since the early 1990s, since the recession of the early 1990s. And so, 2022, 2023, The Agency lost a “significant amount of money.”
He continued, “And in 2024, we were able to right-size the business and get it right around even point, so there were no dividends to disburse.”
Mauricio said he believed dividends were only distributed one year to owners. He said, “The rest of the time we used the money for continued growth, and we continued to reinvest all of the profits into growth.”
The reality star and businessman said he was close with his father and said he was not aware of any other income for Eduardo. Mauricio was grilled about a text he sent Simin’s son on November 24, 2024.
When asked why he sent it, Mauricio said, “I don’t recall. I think that message kind of speaks for itself as to why I sent it. I think that my father was experiencing dementia at the time, and or is experiencing dementia, and I was asking her to just you know, to please stop.”
A portion of the text read, “Regarding your mom and my father, I want to remind you and her that she cannot be speaking to my father.”
Mauricio testified that he has never had any issues with Simin over the 18 years she was with his father.
He admitted Simin no longer works at The Agency.
He said, “We terminated [Simin’s] relationship with The Agency because of the violation of rule number one.” When asked what the rule was, Mauricio said “no assholes.” Simin’s lawyer asked if Mauricio wanted to clarify.
The real estate mogul said, “It just means that we don’t accept poor ethics, poor integrity, misrepresentation of The Agency’s morals.” He alleged that there were three occasions that came to mind. “Two occasions were a verbal abuse in the office that was reported to me which my father was verbally abused, and it was reported by multiple people, and I received those reports.”
Mauricio said the third incident was a video that was sent “to me via Twitter and TikTok that was [Simin] yelling and abusing someone on the streets because of their political beliefs and [Simin] has a license plate that say The Agency on it, and represented that, you know, on all of the LinkedIn, and I received multiple messages from multiple parties in reaction to this tape, and so, therefore, we just between the three of those things, we had to disassociate ourselves.”
As In Touch first reported, in her petition against Simin, Mauricio’s sister claimed she started noticing “signs of threats and abuse” about ten years ago.
“It was difficult to understand exactly what was happening. Around August or September 2022 was when things began to escalate,” Sharon told the court.
Kyle Richards and Mauricio Umansky.
“My father started having bloody arms and bruises. She would hurt him, when he would grab her arms, she would bruise and then threaten to send him to jail for abuse. As his daughter, I am trying to protect him from living out the rest of his life under duress,” Sharon claimed.
“We have known about some of the abuse including verbal threats, sexual manipulation, physical violence and filed a police report but my father is a battered boyfriend and has early signs of dementia and refused to press charges for fear of the threats that Simin has posed on him for many years,” Sharon said.
Simin adamantly denied the accusations. She claimed she was the victim of Eduardo’s abuse and filed for a restraining order against him. In her filing, Simin explained she had been with Eduardo for the past 18 years.
She claimed Sharon was never a fan of hers and tried to break up the relationship many times.
Simin wrote, “[Sharon’s] claims that I am physical abusive are also untrue and ironic. For a long time, I have endured a lot of violent physical abuse from [Eduardo].”
As part of her petition, Simin filed photos showing alleged bruises caused by Eduardo. Simin pleaded for a court order requiring Eduardo to stay away from her and to not contact her.
“During [the relationship], I endured ongoing physical, verbal and emotional abuse. I now fear for my safety due to [Eduardo’s] actions,” Simin said. She accused him of punching her in the face and arms. She also said he shoved her to the ground and choked her.
She added, “These incidents have left me not only physically injured but also emotionally injured.”
Simin said Mauricio’s father’s “violent outbursts appear to be triggered by alcohol consumption and interactions with his family.”
The legal battle is ongoing.
