The MCA was arraigned in court and charged with three counts of misuse of a firearm, willfully obstructing a police officer on duty and creating a disturbance.
According to a statement released by the Directorate of Criminal Investigations (DCI), the politician led a group of locals in setting free a suspect who was in police custody.
It all started when three officers from the Oloosirkon police station embarked on a mission to arrest the suspect involved in an assault and malicious damage case in Ngurunga, Emakoko.
"One suspect, Soipen Samuel, was successfully arrested and placed in a police vehicle, but during an attempt to arrest a second suspect, the husband resisted while a third suspect, Jackline Joshua, remained inside a nearby house," the DCI statement read in part.
The investigative unit stated that this is when MCA Marush allegedly arrived at the scene with a group of approximately 10 people. The men who were reportedly armed with sticks and knives attacked an unarmed officer guarding the suspect and forcibly freed him.
According to the DCI, Marush, who allegedly had a pistol in his hand, led the group he came with to attack a police vehicle.
Following the chaos, two officers who had entered the house of the suspect in pursuit of more people rushed to the rescue of their colleague.
"The two armed officers, who had entered the house to effect more arrests, came to the rescue of their colleague, successfully repulsing the attackers," the DCI further stated.
DCI detectives from Isinya took over the case and forwarded it to the Office of the Director of the Public Prosecution (ODPP).
This came after the ODPP from Kajiado approved Marush's prosecution in the case that dates back to December 2023.
In a separate incident, Ikanga Ward MCA Cyrus Musyoka Kisavi was arrested after he was captured on CCTV footage allegedly making off with mobile phone accessories worth KSh 1.9 million.

The DCI said in a statement that Kisavi was taken into custody after he was named a suspect in the theft incident by the Buscar Courier Services on February 8, 2025.
The footage, which was shared with the DCI, captured the politician allegedly leaving the premises with the package, which was meant for a client located in Mombasa.
He was captured by a security officer from Buscar and taken to the Central Police Station. Upon the confirmation of his identity, he was taken to the DCI detectives in Mombasa for further investigations into his case.
