Fufore tussle: court set date for ruling on jurisdiction - Blueprint Newspapers Limited

A yola High court presided over by justice Musa Usman , has set aside 14 July, 2025,  to delivered ruling on a motion filed by the Adamawa state Government and other defendants in the case  challenging the jurisdiction of the court to hear the case filled by Alh.Musa Ahmed Halilu (Dujiman Adamawa) and two other traditional tittle holders in Adamawa Emirate council, challenging the Governor and state Government’s decision to create Fufore Emirate out of Adamawa Emirate council  calling for its nullification.

Prior to Tuesday’s sitting, the defense counsels lead by the state  Attorney General and Commissioner for justice, Barrister Afraimu Jinki, have challenged the jurisdiction of the court to hear the suit  but the presiding judge Justice.Musa Usman suspended the ruling on preliminary objection until the final judgement  is delivered.

 Not satisfied with this decision, the defence counsels  filed a motion on stay of proceedings at the appellate court challenging the lower court’s decision over jurisdiction issue. 

At the resumed hearing of the case, the Attorney General  reminded the court on the motion  on the stay of proceedings at the appellate court, urging the court to halt its process pending the hearing and determination of their case at the court of appeal leading to heated arguments between the plaintiffs and defence counsels in supports of their positions.

After listening to arguments  on the motions from both sides,the presiding judge,Justice Musa Usman,  adjourned the case to 14 July,2025  for final ruling on the issue of jurisdiction.

Speaking in an interview with journalists after the court session, the barrister Jingi  who spoke on behalf of the defence  counsels said  their decision to challenge the jurisdiction of the court was due to the manner the court handled their preliminary objection challenging its jurisdiction. 

On his part , the lead counsel to the plaintiffs Barrister Manga Mohammed Nurudeen ( SAN) ,   explained that the matter was initially adjourned  for hearing but unfortunately the defence counsels  filed two motions for a stay of proceedings over their appeal at the appellate court which left the court with no option but to first take arguments on the motion for the stay of proceedings after which the case has been adjourned for ruling on jurisdictional issue.
