9th Circuit Halts CA National Guard Case, Giving Trump a Major Victory
The 9th Circuit Court of Appeals has made a significant decision that is likely to disappoint California Governor Gavin Newsom. They have ruled on the Trump administration’s request for a stay pending appeal, granting the motion. This means that for now, the National Guard can continue to operate under federal control.
President Trump had previously federalized the Guard in response to riots in the Los Angeles area that followed protests related to immigration raids. In response, Newsom took legal action by filing a lawsuit in federal court. It is worth noting that Newsom chose to file the suit in the Northern District of California instead of the Central District, which covers Los Angeles. Judge Charles Breyer then issued a temporary restraining order (TRO) requiring the Guard to be returned to state control.
However, shortly after Judge Breyer’s decision, a three-judge panel at the 9th Circuit Court of Appeals issued a temporary stay in response to the administration’s appeal. This development has implications for the ongoing dispute over the control of the National Guard in California.
